The BJP is amazed and disturbed by the conspicuous silence of the government particularly the Prime Minister in the regard to the repeated claims being made by Senior Ministers of the Government demanding religion based reservation including for Dalit Muslims. These demands are not only unconstitutional but designed to promote the worst form of appeasement without constitutional sanction.

The scheme of the constitution is very clear. Under Article 341 the President can specify the caste or part thereof, which shall be a scheduled caste for the purposes of this constitution. Accordingly, the constitution (Scheduled Caste) order 1950 has been issued specifying the scheduled castes for different states. Paragraph 3 of the said order clearly states that “No person who professes a religion different from Hindu (The Sikh or the Buddhist) shall be deemed be members of the scheduled caste. Therefore, the constitution makers and the resultant Presidential notification of 1950 clearly recognises that the gross economic social disability and cultural sufferings has been of a very unfortunate character of the Hindu communities, which called for constitutional protection to the depressed people, who have been the victim of such suffering since ages. This has been the rationale and the philosophy behind the constitutional consensus in the country for the last more than 50 years.

The Supreme Court in the well known case of Soosai Vs Union of India (AIR 1986 Supreme Court 733) has also clearly stated that a scheduled caste on conversion to Christianity is not entitled to welfare assistance available under the constitution order of 1950. The BJP has always supported the economic, social and educational development of the minorities. It has always believed in the motto of justice to all and appeasement of none. The shameless vote bank politics being practiced for the last more than 50 years by the so called secular parties, has established once again that the genuine welfare of the minorities has never been their motivation. The present chorus of demand for religion based reservation is again a dangerous and unconstitutional demand having far reaching implication for the integrity of the country, which the BJP strongly deplores. The party will always oppose any compromise on the existing benefits being given to SC, ST and Backward Castes in the Country.
